Article 1 – Definitions

Under these terms, the following definitions apply:

  • Reflection period: the period within which the consumer may exercise their right of withdrawal;

  • Consumer: a natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Ongoing transaction: a distance contract relating to a series of products and/or services whose delivery and/or purchase obligation is spread over time;

  • Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.

  • Right of withdrawal: the consumer's ability to cancel the distance contract within the reflection period;

  • Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;

  • Distance contract: an agreement concluded within the framework of a system organised by the entrepreneur for the remote sale of products and/or services, using exclusively one or more means of distance communication up to and including the conclusion of the agreement;

  • Distance communication technology: means technology that can be used to conclude contracts without the consumer and entrepreneur being in the same room at the same time.

  • General terms: the applicable general terms of the entrepreneur.

Article 3 – Applicability

These general terms apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms will be made available to the consumer. If this is not reasonably possible, it will be stated before the distance contract is concluded that the general terms can be inspected at the entrepreneur's premises and that they will be sent free of charge as soon as possible upon the consumer's request.

Regardless of the preceding paragraph, if the distance contract is concluded electronically, the text of these general terms will be made available to the consumer electronically before the distance contract is concluded, in such a way that the consumer can easily store it on a durable data carrier. If this is not reasonably possible, it will be stated before the distance contract is concluded where the general terms can be inspected electronically and that they will be sent electronically or otherwise free of charge upon the consumer's request.

If, in addition to these general terms, specific product or service terms also apply, the second and third paragraphs apply mutatis mutandis, and in the event of conflicting general terms, the consumer may always rely on the applicable provision that is most favourable to them.

If one or more provisions of these general terms are at any time wholly or partially invalid or suspended, the remainder of the agreement and these terms shall remain in force, and the relevant provision shall be immediately replaced by mutual agreement with a provision that approximates the original as closely as possible.

Situations not regulated in these general terms must be assessed "in the spirit" of these general terms.

Any uncertainty regarding the interpretation or content of one or more provisions of our terms and conditions must be interpreted "in the spirit" of these general terms.

Article 4 – The Offer

If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

The offer is without obligation. The entrepreneur has the right to change and adapt the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a true representation of the products and/or services offered. Obvious errors or mistakes in the offer do not bind the entrepreneur.

All images and specifications in the offer are indicative and cannot give rise to compensation or termination of the agreement.

Images of products are a true representation of the products offered. The entrepreneur cannot guarantee that the colours displayed match the actual colours of the products exactly.
